Refunds and Warranties

Lathes Online complies with the Australian Consumer and Competition Act 2010 (formally known as the Trade Practices Act 1974) and ensures all members of staff involved in the sales and customer service functions, are trained and understand their responsibilities under the Act.

The goods that we sell fulfil the conditions and warranties that are implied under the Act.

This means our products are:

  1. of merchantable quality, that is, the goods are of a high standard of quality given the price and the description that is provided

  2. fit for the purpose of their design

  3. match the description whether in promotional material, over the phone, in person, on the website or on labelling or packaging

  4. free from defects and faults.

If the goods do not fulfil any of these conditions, you are entitled to a refund upon return of the goods. If the goods have been partially consumed, you may be entitled to a refund depending on the circumstances and the extent to which the goods have been consumed.

Customers can choose an alternative remedy to a refund. In these circumstances you may prefer an exchange, a credit note or for the goods to be repaired at our cost.

If the goods being returned have had a fair amount of use then you may only be entitled to a partial refund. This will depend on the circumstances of the sale and return and if the use of the goods has affected the fault.

You will need to provide proof of purchase, such as the tax invoice or credit record.

You are not entitled to a refund, credit or exchange if you have:

  1. changed your mind, decided you no longer want the goods or just don't like them, or found that goods are the wrong size or colour

  2. found you can buy the same or similar goods elsewhere for a cheaper price

  3. examined the goods before buying them and should have seen any fault at that time

  4. had a defect drawn to your attention before you purchased goods, for example, when goods are clearly labelled as seconds or faulty.

The goods that are sold are free from debt and financing, so that when payment is made, you, as the customer, has free title to the goods.
